OFFICIAL RULES

NO PURCHASE OR DONATION NECESSARY. A PURCHASE OR DONATION WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS DRAWING IS VOID WHERE PROHIBITED BY LAW.

1.       Drawing Sponsor. Operation Smile, 3641 Faculty Blvd. Virginia Beach, VA 23453 (“Sponsor”). Donations received from this Drawing will help fund safe, effective cleft lip and cleft palate surgery, and the delivery of postoperative and ongoing medical therapies to children in low and middle income countries. 

2.       Prize Sponsors. MDS Communications, 545 W. Juanita Ave., Mesa, AZ 85210; Merkle Response Management Group, 100 Jamison Court, Hagerstown, MD  21740;  (“Prize Sponsors”).

3.       Entry Period. See the Smiles (“Drawing”) begins January 1, 2016 at 12:00 am EST (“Start Date”) and ends February 29, 2016 at 11:59 EST (“Drawing Period”).

4.       Eligibility. Open to permanent legal residents of the 48 contiguous United States and District of Columbia (void in Alaska, Hawaii, Puerto Rico and all other U.S. territories and possessions) who are physically located and residing therein and who are at least 21 years old as of the Start Date. Entrants must possess a valid passport and, if selected as the Winner, comply with all Prize Conditions as set forth below. Only one entry per household. Sponsor, Prize Sponsor, their affiliated organizations, advertising and promotional agencies, and any other party associated with the development and execution of this Drawing, and their respective employees, officers, and directors (and their immediate families and members of the same household) are not eligible to enter.

5.       How to Enter. In order to enter the Drawing, visit www.operationsmile.org/entertowin  (the “Website”), or call Donor Relations at 877-240-7196 between 8:30am and 5:30pm ET Monday – Friday, and provide the requested information. You will be given the option to make a donation at the time of entry. Information collected as part of the Drawing will be used by Sponsor to communicate with entrants about the Drawing, and may be used by sponsors to communicate additional information regarding Sponsor’s charitable activities and other opportunities to support Sponsor.

6.       Selection of Winner. All entries into the Drawing that meet the eligibility requirements set forth in these Official Rules will be considered “Eligible Entries.” One (1) entrant will be selected from all Eligible Entries received in a random drawing (“Drawing”) as the Potential Winner (“Potential Winner”). The Drawing will be conducted on behalf of Sponsors on or about March 1, 2016. The Potential Winner will be notified by telephone within one week of the date of the Drawing. Subject to verification of eligibility and compliance with the terms of these Official Rules and the Prize Conditions, the Potential Winner will be declared the Winner of the Prize (“Winner”).

7.       Prizes and Odds. The Winner will receive a five-day trip (the “Trip”) for two (2) to one of Sponsor’s mission sites located in either Mexico or Central America, at the sole discretion of the Sponsor (the “Destination”). The Trip consists of two (2) days for travel, one (1) day to observe patient screenings and two (2) days to observe patient surgeries, and shall include roundtrip economy airfare for two (2) from the international airport located closest to Winner’s residence (the “Departure Point”) to the Destination; four (4) nights’ accommodation in a double hotel room; all meals while at the Destination, ground transportation at the Destination, and any reasonable costs associated with any layovers on flights between the Departure Point and the Destination (collectively the “Prize”). Estimated retail value: $3,000.00.  Actual value will depend on Winner’s city of departure. The trip will likely take place between June and November 2016. The actual dates of the trip shall be determined by the Sponsor, and are subject to change at any time prior to the departure date. Winner and guest must be available to travel on the dates specified by Sponsor or Prize will be forfeited and an alternate winner will be selected. If any Prize-related activity(s) is canceled or postponed for any reason, the remaining part(s) of Prize (if any) will be awarded in full satisfaction of Prize award. Travel and hotel accommodation restrictions apply. Sponsor is not responsible for personal expenses, including telephone calls, insurance and any personal items associated with acceptance of the Prize. Sponsor is not responsible for any costs associated with travel between Winner’s residence and the Departure Point. Prize details not specifically set forth herein are at Sponsor’s sole discretion. Sponsor is not responsible for acts of God, travel delays, or any other circumstance that may arise that is outside of Sponsor’s control which causes cancellation or postponement of any part of the Prize. Sponsor is not responsible for Prize utility, quality or otherwise. Sponsor reserves the right to substitute any part of the Prize for one of equal or greater value. In no event shall the cash equivalent of the retail value of the Prize be issued as a substitute for the Prize. Odds of winning depend on the number of Eligible Entries received. The Prize is not transferable. Taxes and fees, if any, are the sole responsibility of the Winner. The Internal Revenue Service requires Form 1099-MISC to be issued to and filed by the Winner.

8.       Prize Conditions. Winner and guest must: (1) travel on the same itinerary and depart from and return to the same Departure Point; (2) comply with all applicable laws and regulations in connection with the Prize; and (3) be responsible for all other expenses associated with prize acceptance and/or use not specified herein as being provided. Additionally, Winner and guest must: (1) be physically able to travel without assistance; (2) sign all required travel and release documents, including health travel forms; (3) obtain all necessary travel documentation including passports, visas, and travel insurance, and must comply with all customs and immigration requirements; (4) have or obtain sufficient personal insurance (including health insurance) to cover any issues that may arise in connection with the Prize, and provide proof of insurance to Sponsor; and (5) obtain any vaccinations recommended for travel to the Destination by the Centers for Disease Control.  Any costs associated with obtaining vaccinations are the sole responsibility of Winner & guest. Winner & guest consent to permit Sponsor to conduct a criminal background check and agree to be responsible for any associated costs. Sponsor may, in its sole discretion, disqualify any Winner or guest as a result of any information obtained through the criminal background check, or if Sponsor becomes aware of any information or circumstance that may interfere with the ability of the Winner or guest to travel freely across international borders. Winner and guest must each abide by all Sponsor policies, and complete and return the following Sponsor documentation: (1) Health Information Sheet; (2) General Release of Liability; (3) Communications Policy; and (4) Travel Policies. Winner and guest will only be permitted to share photographs or video from the Trip that have been pre-approved by Sponsor.

9.       Verification of Winner and Delivery of Prize. The Winner will be required to sign an affidavit of eligibility and liability release and, where permitted, a publicity release. The Prize may be awarded to an alternate winner selected by random drawing if the Potential Winner cannot be reached within one week after Sponsor contacts the Potential Winner by telephone, or if the Prize is returned as undeliverable, or if the affidavit/release is not returned within three (3) business days after it is sent to the Potential Winner, or if the Potential Winner or guest do not comply with these Official Rules or the Prize Conditions. If the Prize is won by a minor, it may be awarded in the name of a parent or legal guardian in Sponsor’s sole discretion. All entries are subject to verification at any time. Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility in a form acceptable to Sponsor to participate in this Drawing. In the event of a dispute as to the identity or eligibility of any potential winner based on an email address, the entry will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. The authorized account holder of an email address is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Failure to provide such proof in a timely manner may result in disqualification. The Potential Winner may be required to provide proof in a form acceptable to Sponsor that he/she is the authorized account holder of the email address or phone number associated with an entry.

10.    Entry Disqualification. Sponsor reserves the right, at its sole discretion, to disqualify anyone from this Drawing or any other promotion conducted now or in the future by Sponsor if he/she tampers with the entry process or if his/her misconduct affects the integrity of the Drawing. Sponsor is not responsible for, nor is Sponsor required to count, in its sole and absolute discretion, late, lost, misdirected, or unlawful entries that are submitted. Use of automated devices or methods to enter the Drawing is prohibited.

11.    Limitation of Liability. Sponsor, in its sole discretion, reserves the right to suspend, cancel or modify the Drawing without notice or liability if the integrity of the Drawing is compromised in any manner as determined by Sponsor, or if the Drawing is not capable of being conducted as intended by Sponsor. If the Drawing, or any part of it, is discontinued for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all Eligible Entries received up to the date of discontinuance for any or all of the prizes offered herein. Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Drawing, but in no event shall such claims, judgments, or awards include attorney’s fees.

12.    Release and Indemnity. As a Drawing entrant, you agree to release Operation Smile, Merkle Response Management Group, and any parties associated with the development and execution of this Drawing, and each of their respective subsidiaries, affiliates, successors, licensees, and assigns, and their respective officers, directors, and employees (collectively, the “Indemnitees”), from any and all loss, liability, damage, cost, or expense arising out of or in connection with, this Drawing, including, but not limited to, any suspension, modification or cancellation of the Drawing, and/or acceptance or use of any prize or any other part of any prize, including liability for personal injury, damages or loss. Furthermore, by participating in the Drawing, you agree to indemnify, defend and hold harmless Indemnitees, from and against any and all claims, losses, damages, liabilities, and costs and expenses (including reasonable attorneys' fees) which arise out of any breach of these Official Rules. Indemnitees are not responsible for any malfunction of the Website, or any late, lost, damaged, misdirected, incomplete, illegible, undeliverable, or destroyed entries due to postal service issues, system errors or malfunctions, hardware or software failures of any kind, lost or unavailable network connections, typographical or system/human errors and failures, technical malfunction(s) of any telephone network or lines, cable connections, satellite transmissions, servers or providers, or computer equipment, traffic congestion on the Internet or the Website, or any combination thereof, including other telecommunication, cable, digital or satellite malfunctions, or for theft or destruction, tampering, or unauthorized access to entries and/or entry information which may limit your ability to enter.

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL INDEMNITEES BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIMS.

13.    Governing Law. Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of or connected with the Drawing or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Virginia Beach, Virginia without regard to any conflicts of law principles.

14.    Winner’s Name. Winner Name requests will only be accepted after the end of the Drawing Period and no later than June 30, 2016. For the Winner’s Name, email drelations@operationsmile.org.
